Contested Divorces

These divorces are, unfortunately, the most common. A contested divorce occurs when two spouses cannot agree on child custody, property, payments, and other issues, so they have to bring it before the court, in order for a judge to make a ruling for them. The process begins when one spouse files a petition for divorce and the other will respond. Then, the period of the discovery phase begins. Each spouse must begin collecting their paperwork: evidence of their property claims, depositions, and interrogatories.

Uncontested Divorce

An uncontested divorce does its best to avoid the painful drama of the courtroom. The two spouses settle their complex issues, like child support and custody rights, outside of the court in mediation.

In Texas, an uncontested divorce must have the following requirements:

  • No children under 18
  • Both spouses want to end the marriage
  • Neither spouse has bankruptcy cases ongoing
  • Neither spouse has property or alimony disputes

Grounds for Divorce in Texas

There are several reasons Texas allows for a couple to use when filing for divorce.

  • Insupportability – This is when a marriage cannot be sustained due to a “discord or conflict of personalities” without any “reasonable expectation of reconciliation”. In essence, this is a “no-fault” divorce.
  • Separated – If the spouses have already lived apart in separate households for at least three years, then they can file for divorce.
  • Mental Disorder – A spouse can file for divorce if the other spouse has been admitted to a state or private mental institution for at least three years and a permanent recovery is unlikely.
  • Cruelty – A spouse can file for divorce based on the grounds that the other spouse acts with cruelty making living together insupportable.
  • Abandonment – A spouse can file for divorce if the other spouse has intentionally left and has been gone for one year or more.
  • Convicted of a felony – If a spouse has been convicted of a felony and served at least one year in prison, then the other spouse can file for divorce.
  • Adultery – The spouse filing for divorce on this ground must be able to prove that the adultery occurred.

Another requirement for divorce in Texas is that one of the spouses must be a Texas resident for at least six months before filing for divorce. Furthermore, the spouse must be a resident of the county where the divorce is going to be filed for at least 90 days before filing.
